These definitions can be difficult sometimes. The shop I work for has a bunch of "new" stuff, some of it still in the package, which was stored under a leaky roof :( (fortunately its almost all cheap stuff) We also get lots of things from our supplier which don't come in a package at all, that I'd still call new.

The headset in question would be better described as a takeoff, but I'm guessing that many ebay buyers wouldn't understand or search for that term.

I have to disagree with your interpretation of new. I do not think that an item that has been installed in any way, shape, or form should be represented as new. To me new is something that may have been out of the package for inspection and then replaced. Maybe a better description is take-off. [As in installed and removed ]

Secondly I think the use of the term NOS is grossly overused by sellers in listings. My evaluation system reduces the price of an item by 20- 30% if it is not fresh and in the original packaging. That to me is NOS.

There is nothing wrong with these take-off / out of the wrapper items. They are just not 'NOS' in my mind's eye.If a merchant or seller sold me an item without telling me it had been used prior; I would not be very pleased.

There is nothing wrong with these take-off items as long as they are not represented as being 'NEW.'
