I don't know the circumstances of Hetchins, but continuity is not a valid argument. There was a company that bought all the remaining parts from Indian Motocycle when they closed and sold complete Indian motorcycles and parts for decades before anyone became interested in resurrecting the name the 80s, and they lost any claim to using Indian.
