There is absolutely no law requiring the use of helmets for adults in the US (I believe only Australia has gone that far), so I can't see how there can be any liability issue. There is probably a greater chance of liability issues that could emanate from a requirement to oblige people to go beyond the law. Don't forget, that no safety device is failsafe and functional in every event. While highly uncommon, helmets have led to a rare injury (usually due to incorrect fitting) What could happen if somebody not accustomed to riding with a helmet (this might shock American sensibilities, but there are far more people that ride without helmets than with helmets in this world of ours!) gets hurt in one of these oddball accidents. My advice to both Dale and Chuck would be to recommend participants to wear approved helmets, but not require it.
