Ebay offers Safe-Waster...I mean Safe Harbour. They basically promise the world and do nothing in return. I appreciate the enormous feedback. I believe I will make an attempt to contact the seller by phone, and just be nice and hope for the best. most likely, I will just sell the bike for a loss to re-coup some cost. Thanks all for the advice, much appreciated

All things considered, it sounds like fraud to me. Certainly the misrepresentation of sizing alone substantiates that claim.
   Beyond that, it's hard to imagine the seller didn't know about the kickstand damage. I don't know what ebay does in the case of fraudulent auctions but in this case I think you should try and use whatever services are available.
