Douglas, there's a feature within the eBay site where you can contact eBay and let them know the photos are stolen. I'm not sure if they have to have been stolen from another eBay auction or not, maybe so. But it's worth a try.
Go tho the guy's auction page. Scroll to the very bottom of the page and look for the heading "Other Options". From there you can select the link "Report this item" and it will take you through the proceedure for reporting it to eBay and hopefully they will shut down the auction.
