Well, it should not do that! For some reason your quick release device is not going to the fully "over center" position - it is hanging up short of the fully closed position.
Does the QR feel smooth as it takes up the slack ? Is the 7mm nut tight? Is it possible that the QR was re-assembled incorrectly, for example, the cable fixing bolt is on the inside, not the outside?
I recommend take the thing apart, clean and re-grease everything.
